These Terms of Service ("Terms") govern your use of the HabitIt mobile application (the "App"), operated by HabitIt ("we", "our", or "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and that the information you provide is accurate.
Some features require an account created via Google Sign-In, Apple Sign-In, or email. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for your personal, non-commercial use.
Billing: The App offers optional paid subscriptions and one-time purchases (together, "Purchases"). All Purchases are processed by Apple App Store or Google Play and are subject to their respective terms.
Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your device's account settings.
Refunds: Refund requests for subscriptions and in-app purchases must be submitted through Apple App Store or Google Play per their policies. We cannot process refunds directly.
Free trial: If a free trial is offered, the subscription begins after the trial period ends unless you cancel before then.
You retain all rights to habit data, journal entries, notes, and other content you create in the App ("User Content"). We do not claim ownership of your User Content.
By enabling cloud sync or profile sharing, you grant us a limited license to store, transmit, and display your User Content as needed to provide these features.

The App integrates with third-party services including Firebase, Google Sign-In, Apple Sign-In, RevenueCat, AdMob, HealthKit, and Health Connect. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services.
You may stop using the App and delete your account at any time from within the App. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (including disclaimers and limitations of liability) will remain in effect.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
The App is a self-help tool and does not provide medical, psychological, or professional advice. If you are dealing with a health condition, please consult a qualified professional. Health data synced through the App is informational only and should not be relied on for medical decisions.
To the maximum extent permitted by law, HabitIt and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from your violation of these Terms or your misuse of the App.
We may update these Terms from time to time. Material changes will be notified through the App or at this URL. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of your jurisdiction of residence, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
